| THE "SPORTSBUY PROTECTION GUARANTEE"

SportsBuy buyers (US only) are guaranteed to receive their purchased item as advertised or their money back! On SportsBuy, buyers pay for their purchases through SportsBuy. SportsBuy protects the buyers funds for up to 12 days after the purchase. In the event that a buyer doesn't get their item as advertised, then the buyer deals directly with SportsBuy and doesn't have to worry about tracking down a seller. This buyer protection has allowed millions and millions of transactions to take place on the SportsBuy Marketplace with the buyer always getting their item as advertised or their money back.

| BUYER POLICIES |
|
Buyers do not need to notify SportsBuy or the seller after receiving satisfactory merchandise, however, buyers should 'check' the RECEIVED, located within the My Current Transactions page found in the My Account Page.
If an item is not received within ten (10) days or the merchandise is received damaged, incomplete or misrepresented, THE BUYER MUST NOTIFY THE SELLER IMMEDIATELY. If a seller is unresponsive, the buyer must notify SportsBuy Customer Care with the SportsBuy Transaction # within twelve (12) days of the transaction date. SportsBuy buyers that abuse the buyer guarantee by filing frivolous or erroneous disputes will be permanently removed from the SportsBuy.com.
In order to make a purchase, a buyer must pay for the item upon checkout with either PayPal, Credit Card (MC/Visa) or with cash in their account. Buyers can pay with a check or money order on the checkout page and mail that in to SportsBuy to be executed. Users can deposit funds into their account with PayPal and/or Credit Card. In addition, users can also place a valid credit card on file. In the event that a user has a positive balance in their SportsBuy account, SportsBuy will always debit that account prior to debiting a buyer's credit card (if necessary).

| PAYING FOR A PURCHASE |
|
A user may pay for a purchase by:
- Paying with a valid credit card or PayPal on checkout or having a credit card on file.
- Having a positive account balance by depositing funds prior to a purchase via a Credit Card, PayPal, Check/M.O. or from the sale of an item on SportsBuy (once a transaction has cleared, funds will be placed into the account).

FILING DISPUTES
|
|
If you have not received your order as advertised within 7 days of your purchase, send an email to the seller notifying him/her of the item you purchased along with your dispute. The seller's email address can be found on the Transaction Information link found within the Current Purchases page in your SportsBuy Account. If the seller does not respond, you then file a dispute by clicking on the File Dispute link located on your Current Purchases page. After you initiate a dispute, the funds will be immediately held from going into the seller's Cash Account until the seller or SportsBuy Customer Care resolves the dispute.

| SHIPPING & INSURANCE POLICY |
|
Who determines the Shipping & Insurance on SportsBuy? SportsBuy dictates all shipping and insurance charges on all transactions. It is SportsBuy's policy that shipping and insurance will not be a source of profit, however, it will be enough to cover all the costs associated with shipping an item out. Therefore, SportsBuy has established shipping and insurance rates that are deemed consistent and fair for both buyers and sellers. The shipping and insurance charges are based on the United States Postal Service rates and established by combining the purchase price, item weight and shipping distance. SportsBuy sellers are liable for all merchandise that is damaged, incomplete or lost. Buyers must pay insurance on transactions over $25.00 (unless the item(s) is part of a free shipping promotion).
Is it mandatory that a seller insures the item? No it is not mandatory however it is highly reccommended. While buyers are required to pay insurance for any purchase over $25.00 a seller who chooses not to insure the item is therefore accepting responsibility and essentially self-insuring the item. If an item is lost or damaged in the mail and the seller did not insure the item, SportsBuy will reverse the transaction and give the buyer their money back, while the seller will not be reimbursed.
Automated Combined Shipping: SportsBuy has an automated combined shipping feature that combines the shipping costs on all purchases made between the same buyer and seller within the same calender day (PST). (Click here to view SportsBuy's Shipping & Insurance Rates)
Record Keeping: Sellers are required to collect and maintain all shipping records on SportsBuy for a minimum of two years. |

SportsBuy prohibits autographed items to be listed or sold without a valid Certificate of Authenticity (COA) from a licensed company. COA's from individuals will not be permitted (i.e.: COA from John Q. Public). In addition, Letters of Authenticity (LOA) or Notarized Letters will not be accepted.

SELLER POLICIES |
Sold items: Sellers are responsible for getting items they sold on SportsBuy out within 3 business days. Sellers are required to mark the item shipped on their current sales page after they have shipped the item. Marking the item shipped will send the buyer an automated shipping confirmation email. The SportsBuy Transaction # must accompany all merchadise shipped out.
Unable to deliver an item sold: If sellers are unable to complete a transaction as advertised, they are to contact the buyer as soon as possible and offer them an item of equal or greater value. If a reply is not received or if the offer is refused, the seller is instructed to contact CustomerCare@SportsBuy.com with the transaction number and the reason for the reversal.
Responsibility of current listings: Sellers are required to manage, maintain and keep
all sell listings current. Sellers that fail to manage their SportsBuy inventory risk penalty fees (see below)
and suspension and/or permanent removal from SportsBuy.com.
Condition of merchandise: Sellers who fail to follow the SportsBuy Condition /
Grade Guidelines by misrepresenting any item, in any way, intentional or not, will be
assessed a penalty fee (see below) and risk suspension and permanent removal from SportsBuy.com.
Autographed Cards: Sellers can list all autographed cards that have been purchased or pulled out of a pack of cards as "autographed" in their listing description. Sellers selling cards that have been hand-signed (obtained in person and/or not through a card manufacturer) must clearly describe the item as such and also must include a COA (Certificate of Authenticity) that is accompanying the card. Sellers not properly describing a hand-signed autographed card listing, will be responsible for all transaction, reversal penalty fees and return shipping in the event a buyer requests a reversal.
Autographed Memorabilia : All autographed memorabilia items must include a COA (Certificate of Authenticity) from a reputable third-party company such as PSA, Upper Deck, Steiner, Topps, etc.. In addition specific COA's are not allowed. Please see above for a list of approved and not-approved COA's. |

SportsBuy has no listing fees. Sellers can list as many items as they want for no cost. After an item sells a transaction fee will subtracted from the purchase.

Combined Transaction Fees
When the same buyer makes multiple purchases from the same seller within the same calendar day, the buyer's shipping costs are combined with a minimum $.60 shipping fee applied to all additional purchases. In addition, SportsBuy also combines transaction fees, so that the seller is not charged the full transaction fees. *Please note that the Payment Processing fees below are not combined, because a buyer may be purchasing each additional item with a credit card and/or PayPal.

PAYMENT PROCESSING |
|
All payments for items sold on SportsBuy are processed by SportsBuy. Sellers are charged a payment processing fee of $0.39 plus 2.99% of the
total transaction amount.
Why this fee? 75% of purchases on SportsBuy are done with a credit card or PayPal, in which the
credit card company and PayPal charge a fee (2.99% + .35 per transaction). When a buyer uses an American Express
or Discover card, SportsBuy's fees are 3% + .29 per transaction. SportsBuy is also charged a fee any time a buyer
disputes a charge and SportsBuy also covers all the costs when items have been purchased
with a fraudulent credit card (subject to a maximum of $1500). |

PENALTY FEES |
Sellers face penalty fees for committing any of the following:
|
- Failing to ship merchandise promptly
- Failing to properly package merchandise
- Failing to notify SportsBuy immediately of inability to complete a transaction
- Sending merchandise that fails to meet the SportsBuy Condition/Grade Guidelines
- Sending merchandise that is different than the item sold
|
|
Sellers who violate any of the above will pay one or more of the following:
|
- Transaction fee
- Credit card fee (if applicable)
- Return shipping costs (if applicable)
- $ 10 penalty fee
|
RETURNED CHECK PENALTY |
|
SportsBuy Users will be assessed a $35 transaction fee on all returned
checks.

| GETTING PAID |
|
Once a transaction occurs (wheter this is a payment from an auction, private offer or from a purchase in a shopping cart) the payment is automatically debited from the buyer's SportsBuy Cash Account (or credit card if funds are not available in the cash account) and placed directly into the Seller's Pending Account. The payment will then be transferred into the Seller's SportsBuy Cash Account based on the payout process listed below.
Sellers get paid based on their level of membership:
- VIP Premier Members - paid 3 days after the seller has clicked the shipped box confirming the item has been shipped (up to a $1500 draw). The balance is received 12 days after clicking on the 'shipped' check box and the shipping confirmation button.
- VIP Certified Sellers - paid 3 days after the seller has clicked the shipped box confirming the item has been shipped (up to a $750 draw). The balance is received 12 days after clicking on the 'shipped' check box and the shipping confirmation button.
- VIP Members - paid 6 days after the seller has clicked the shipped box confirming the item has been shipped (up to a $250 draw). The balance is received 12 days after clicking on the 'shipped' check box and the shipping confirmation button.
- SportsBuy Regular Members - paid 12 days after the seller clicks the 'shipped' check box and the shipping confirmation button.
Note: Sellers who mark their items shipped before they are actually sent may face penalty/reversal fees and/or expulsion from the SportsBuy Exchange.
Once funds reach your SportsBuy Cash Account, you may make a purchase, request PayPal or check withdrawl or simply leave in your SportsBuy Cash Account for a future purchase or withdrawl. Please note: SportsBuy is not a bank and thus not FDIC insured.

| SPORTSBUY'S RIGHT OF REVISION |
|
SportsBuy reserves the right to alter or delete an incorrect or misrepresented marketplace listing at anytime.
The marketplace may be removed entirely or merged into an existing one to prevent incorrect
transactions (i.e. A marketplace for a 1988 Topps Barry Bonds Rookie Card would be deleted because
that is not his rookie card).
SportsBuy reserves the right to suspend or remove a user at any time. Reasons for suspension and or removal from the site include, but are not limited to the following; - Non-delivery of goods.
- Goods delivered were misrepresented or counterfeit.
- Account has been inactive for more than 18 months. (Inactive account is a user without any new listings and/or transactions during that period).
- Inaccurate email, phone number, credit card and/or address on file.
- Attempted payment using a fraudulent credit card, PayPal Account and/or check.
- Unacceptable interaction with another SportsBuy User or SportsBuy employee.
- Posting of inappropriate pictures, descriptions and/or items.
- Attempted acts to purposefully sabotage SportsBuy, its marketplace, its users or the company in general.
- Any intended guidance or misdirection by a SportsBuy seller that could result in a transaction off of SportsBuy (i.e. advertisement of another website, phone number or direct email) will be construed as a violation.
In addition to any other remedies at its disposal, SportsBuy is entitled to secure compensation for costs incurred as the result of a user engaging in any of the above prohibbited activites.
SportsBuy will be notify users who are suspended so that they can appeal their case. Once a user has been permanently removed their monies will be removed and they will be prohibited from registering on SportsBuy under a different account.

| RESPONSIBILITY FOR TAXES |
SportsBuy is a venue only and is not responsible for the collection or remittance of any state and/or local sales taxes. Buyers and Sellers are responsible for all tax-related issues that may arise. SportsBuy recommends that seller's add into their sale price any additional fees and/or taxes that they will be responsible for if their item should sell. Buyers, sellers do have a right to request taxes after a transaction if they are required. However, all collection of taxes will not occur on SportsBuy and must be worked out between the two-parties. Sellers have the right to cancel a transaction if the buyer refuses to pay applicable taxes. |

| SPORTSBUY SELLER RATINGS/FEEDBACK |
|
SPORTSBUY WILL NOT TOLERATE ANY MISREPRESENTATION, FRAUD, DECEPTION,
TRICKERY, LYING, EXAGGERATING OR SCAMMING.
When a buyer reports to SportsBuy that a seller has not delivered their purchased merchandise as advertised or in a timely manner, SportsBuy will investigate the claim and deduct the seller's rating.
If SportsBuy
finds the action of any user to be deceptive or disingenuous, in any
way, intentional or not, SportsBuy will remove all user privileges immediately
and permanently. SportsBuy reserves the right to remove any user at any time.
ANY ACT OF DECEPTION OR FRAUD WILL RESULT IN IMMEDIATE
AND PERMANENT REMOVAL
